At midnight, a towing company’s driver collided with a pedestrian on a bridge in Indio.  After the accident, the towing company obtained a defense verdict at trial.  The jury found that the defendants were not negligent.

On appeal, Plaintiffs attacked the trial court’s admission of evidence that the pedestrian had tested positive for alcohol and methamphetamine, arguing the evidence was unreliable and should have been excluded.  Agreeing with GMSR’s arguments, the Court of Appeal affirmed the judgment, holding that the alcohol testing evidence was properly admitted and that any error in admitting the methamphetamine evidence was harmless.
