Bob Olson published in Daily Journal: “On Judgments”

In today’s Daily Journal, GMSR’s Bob Olson writes that a recent case currently pending before the California Supreme Court—Meinhart v. City of Sunnyvale (2022) 76 Cal.App.5th 43—”highlights the confusion in California law as to what is or is not a judgment.”

To clear up this confusion in the law, Bob suggests that:

  1. California should adopt the federal separate judgment rule;
  2. Attorney fee motions and motions for Code of Civil Procedure section 998 costs should stay the finality of judgments; and
  3. Judgments should be cut down to contain only the information essential to enforcement.
