Maciel v. Los Angeles County Metropolitan Transportation Authority (Jan. 27, 2015, B255975) 2015 WL 340634

Plaintiff claimed personal injuries and property damage after falling on an MTA bus.  The trial court dismissed his personal injury claims for failure to comply with the Government Claims Act, leaving only his $270 property damage claim for a broken iPod.  Plaintiff stipulated in open court to settle that claim for $270.  After cashing MTA’s check but refusing to file the promised dismissal, he tried to revive the lawsuit.  The trial court rejected his efforts, and the Court of Appeal agreed, holding that the record showed a valid settlement and dismissal.
