#26-143 Harland v. City of West Hollywood, S297247. (B343375; 120 Cal.App.5th 1166; Los Angeles County Superior Court; 24SMCV00872.) Petition for review after the Court of Appeal affirmed the judgment in a civil action. This case presents the following issue: If a plaintiff prematurely files a lawsuit against a public entity while a Government Claims Act (Gov. Code, § 810 et seq.) claim remains pending, and subsequently voluntarily dismisses the lawsuit without prejudice, is the plaintiff barred from filing a second lawsuit based on the same claim?
