The Court of Appeal handed GMSR’s client, the County of Los Angeles, a complete victory in a challenge to the County’s no-bid contract for pharmacy administrator services needed to implement provisions of the Affordable Care Act.
After the trial court invalidated the contract on the ground that it did not qualify for an exception to competitive bidding, GMSR persuaded the Court of Appeal to reverse. The Court held that the trial court failed to give sufficient deference to the County’s determination that the contract involved urgent, highly technical services requiring specialized expertise that could not be provided in-house.
The decision directs judgment for the County, vindicating its contracting process and preserving its ability to respond quickly and effectively to public health needs.
