GMSR successfully defended an attorney fee award for its clients in a Song-Beverly Consumer Warranty Act action against FCA US. FCA argued that plaintiffs could not recover fees incurred after its initial settlement offer, which exceeded the eventual jury verdict.
The Court of Appeal rejected FCA’s argument, holding that the trial court acted within its discretion in awarding reasonable fees. The court affirmed the fee award in full, along with costs on appeal.
