GMSR won a significant appellate victory for its clients against Ford Motor Company over a defective 6.0-liter diesel engine. A jury had found Ford liable for fraud and warranty violations, awarding compensatory damages, statutory penalties, and punitive damages.
On appeal, Ford challenged the verdict on multiple grounds, including evidentiary rulings, damages, and the availability of both statutory penalties and punitive damages. The Court of Appeal rejected Ford’s arguments in large part, upholding the fraud and warranty findings and affirming substantial damages for GMSR’s clients.
