Burch v. Children’s Hospital of Orange County Thrift Stores, Inc. (2003) 109 Cal.App.4th 537

The Court of Appeal held that the plaintiff’s unapportioned, joint Code of Civil Procedure section 998 settlement offer to multiple defendants was invalid, even where all defendants stipulated to joint and several liability at trial, thus saving GMSR’s client $4 million in pre-judgment interest and expert fees.
