Marco Pulido

Biography

Marco A. Pulido has litigated appeals in California and beyond for nearly a decade.  He has handled a broad range of appeals—including cases involving contract and business disputes; employment matters; suits against public entities; 42 U.S.C. § 1983 claims; and premises liability.  He also regularly teams up with trial counsel on strategizing and preparing key trial court motions and postjudgment filings.

In recent years, Marco has been recognized by both Best Lawyers in America® and Southern California Super Lawyers for his appellate practice.  And he has been instrumental in securing successful outcomes for clients involved in high‐stakes litigation.  Examples include:

  • Securing affirmance of a judgment rejecting fraud and misrepresentation claims against property developers after a summary judgment order and bench trial, in an appeal stemming from a $30+ million sale of commercial property.
  • Winning reversal of a combined $5.3 million judgment and attorney fee award stemming from a seven-week jury trial on whistleblower retaliation claims.
  • Securing affirmance of a summary judgment order rejecting premises liability claims against a property manager.
  • Securing affirmance of an order challenging the denial of prejudgment interest on an order enforcing a settlement under Code of Civil Procedure 664.6.
  • Obtaining California Supreme Court review of a Court of Appeal decision refusing to enforce a forum selection clause.
  • Securing affirmance of a trial court order staying a duplicative action on claim‐splitting grounds.
  • Winning full dismissal of a citation and its associated penalty and injunctive-relief requirements, in an appeal to the Cal/OSHA Appeals Board.
  • Assisting with an appellate reversal of a multimillion‐dollar judgment, followed by successful opposition to review before the California Supreme Court.
  • Winning summary affirmances in two Ninth Circuit appeals involving claims under 42 U.S.C. § 1983.
  • Achieving Ninth Circuit affirmance of an order denying a preliminary injunction in a case involving Fair Housing Act claims.
  • Winning Ninth Circuit affirmance of a summary judgment order dismissing breach of contract and trademark claims.

Before joining GMSR, Marco worked at a large, international law firm where he successfully litigated cases in both trial and appellate courts.  He also served for two years as a federal judicial law clerk to the Hon. Bruce J. McGiverin and externed for Justice Richard M. Aronson on the California Court of Appeal.

Over the years, Marco has given back to those in need as well:  He has dedicated hundreds of hours of his time to pro bono cases and amicus briefs in state and federal appellate courts—including the U.S. Supreme Court.
