GMSR secured a complete appellate win for Fidelity National Title Group, Inc. in a case involving employment-related claims. The plaintiff alleged discrimination, retaliation, and intentional infliction of emotional distress following her termination. Although a jury rejected her discrimination and retaliation claims, it awarded more than $1.1 million on her emotional distress claim.
On appeal, GMSR persuaded the Court of Appeal that California’s workers’ compensation system provides the exclusive remedy for such claims absent proof of unlawful discrimination or retaliation. The Court reversed the $1.1 million judgment and directed entry of judgment in Fidelity’s favor.
