Citizens Business Bank v. De Mille (June 9, 2010, B209518) 2010 WL 2295011

The Court of Appeal ruled in favor of the successor trustee of a living trust in two related appeals.

In the first appeal, the court upheld a probate judgment that nullified the transfer of valuable personal property, including collectible vehicles and motorcycles, from an appellant to a second appellant. In the second appeal, the court affirmed the judgment, rejecting the argument that the trustee was prevented from enforcing a bond, upholding its right to collect the funds.

Ultimately, the court’s decision in both cases protected the trust and its beneficiaries from the appellant’s fraudulent actions and affirmed the trustee’s role as the rightful administrator.
