In a case with multi-billion dollar implications, GMSR appeared for amicus curiae urging that the California Supreme Court preclude recovery as medical economic damages of the difference between the amount that a healthcare provider bills to the patient and the amount that the provider has agreed by contract to accept as payment in full from the plaintiff's health insurer. Accepting GMSR's arguments, the Supreme Court held that a plaintiff's recovery for economic medical damages cannot exceed the lesser of the amount actually accepted by the healthcare provider as payment in full or the reasonable value of services, rather than the face amount of an unpaid bill.
