The Court of Appeal affirmed the denial of class certification and the granting of summary judgment. Plaintiffs sued the Regents challenging the surgery procedures in UC hospitals, alleging that residents frequently performed surgeries for emergency patients in the absence of the surgeon who was designated in the consent form; that residents were doing the hands-on procedures while teaching surgeons merely supervised; and that surgeons were routinely absent for portions of surgeries which were performed by residents. Plaintiffs referred collectively to these acts as "ghost surgery." GMSR assisted at the trial court level and handled the appeal.
