The California Supreme Court held that an Emergency Medical Treatment & Active Labor Act (EMTALA) claim based on “failure to stabilize” a patient prior to transfer is subject to the $250,000 limitation under California’s Civil Code section 3333.2 of the 1975 Medical Injury Compensation Reform Act.
