Weinberg v. Cedars Sinai Medical Center (2004) 119 Cal.App.4th 1098 California Court of Appeal 05/18/2004
The Court of Appeal upheld GMSR client hospital's decision to terminate a physician's staff privileges. Its first-impression decision holds that while a hospital's board of directors must give great weight to a peer-review body's decision, it nevertheless may exercise independent judgment as long as it does not act arbitrarily or capriciously.
