Briefs: Representing Respondents/Appellees
Legesse v. Alta Bates Medical Center (2003) 2003 Cal.App. Unpub. LEXIS 2195
03/06/2003
Authored by
Martin Stein,
Barbara Springer Perry
Practice Area: Civil Procedure California Court of Appeal
The Court of Appeal affirmed the dismissal, agreeing with the trial court that plaintiff lacked standing to pursue any claim relating to allegations that her daughter's consent to an abortion was coerced and that she also lacked standing to maintain the lawsuit in pro per on behalf of her daughter. In affirming a demurrer, plaintiff was also found repeatedly not to have alleged facts sufficient to sustain a cause of action on her own behalf for infliction of emotional distress.
